Bond Information

Below are the main ways to post a bond and information on how to do it. Keep in mind that if you post someone’s bond, you are ensuring their presence in court. If that person doesn’t return to court, you could end up owing the full value of the bond to the court.

  1. Post the full bond with cash -  The easiest way is to pay the bond at the Sheriff’s office at 730 S Dupre St. 24 hours a day for both Criminal District and Municipal Court charges.  A $30 fee is charged for posting the full bond.  This can also be done in the courthouse in the Clerk’s office during business hours, 9am – 3pm, Monday – Friday, for a $10 fee. In Municipal Court, bonds can be paid in the designated courtroom only while that section is in session. Municipal Court only accepts cash.                                                          
    1. If you are OUT OF STATE, you can post the full bond with a money order through Western Union. Details on how to do that can be found here.
  2. Post the bond through a bail bondsman - This is known as a commercial surety bond. Most bondsmen charge between 13% and 15% of the total bond amount and many will negotiate a down payment and payment plan if necessary. These are simply common examples. Each bondsman is different and each situation is different.
    1. The primary difference between posting the full bond and going through a bondsman is when using a bondsman, you never get your money back. It is a fee to the bondsman for posting your full bond with the court. If you post the full cash bond with the court and the person you bonded out goes to all court dates, the full bond is returned.
  3. Put up a house or other land as a property bond - This is known as a secured personal surety bond. In order to post a property bond, you must have as much equity in your house as the value of the bond. Instructions can be found here.

  4. Sometimes a judge will offer an Unsecured Personal Surety Bond. This option is only available if the judge expressly offers this option. It is usually called a “PSBU” or a “Personal Surety Bond.” In order to post a personal surety bond, someone must come to the courtroom that set the PSBU, sign a document ensuring the person returns to court, and pay a $250 non-refundable fee.

Property Bond Procedures

 Please Read this entire document provided by the Clerk of Court

New requirements in the law, Code of Criminal Procedure, New Article 319 effective June 23, 1993, The value of the security interest must be equal the full amount of the bail as set by the court. These requirements shall not be waived. Repeated Article 315 Bail Reform Act of 1994 effective September 1, 1994. Mortgage and Promissory notes submitted for security of property bonds need only be for amount equal to bond set by court.

NOTE: It is your responsibility to determine if you have enough equity in the property to post bond. There is no guarantee that the bond certificate will be acceptable to post bond.

 Instructions to post a property bond:

  1. Find out the amount of the bond to be posted from the Bond Department of the Criminal Court Clerk's Office, Criminal Sheriff or Magistrate Judge during the hearing. They are located at 2700 Tulane Avenue, Room 104.

  2. Bring a copy of the Deed (mortgage papers) if available at home.

  3. Go to your district assessor's office to get the assessment of the property (4th floor in City Hall)

  4. Go to the Mortgage Division for a preliminary review. The Conveyance Division and the Mortgage Division are located on the 4th floor at 1340 Poydras St. in the Amoco Building.

  5. Go to the Conveyance Division and request a property bond certificate. The Conveyance Division will type the forms for their Division and the Mortgage Division.

  6. After the certificates are typed bring them to the Mortgage Division. The Mortgage Division will process the mortgage certificates. You will return the Conveyance form to the Conveyance Division.

  7. All inscriptions recorded in the records against the owner(s) name(s) and property will be reported on the certificate. If the subject property was acquired by any means other than an act of sale, the former owners name will be added to the certificate. You may research the records to see what inscriptions are recorded against your name. The Mortgage Division must report all inscriptions against your name and property. With common names some inscriptions may not apply to you, but they most be recorded on the certificate. If this happens, we can assist you on how to get the information to have the inscription NULL and VOIDED on the certificate.

  8. If you decide to have the certificates processed you will bring the conveyance certificate back to the Conveyance Division to be processed. There are no refunds on the processed certificates when competed. The exact amount of time to process certificates will depend on the research of the names. Please all at least an hour's time when the research begins to process the certificates.

  9. After both mortgages and conveyance certificates are completed, take them with the Assessor's assessment to the Bond Department of the Criminal Court Clerk's Office at 2700 Tulane Ave, Room 104.

  10. The Criminal Court Clerk's Bond Department will determine if there is enough equity in the property to post bond.

  11. The Clerk in the Bond Department of the Criminal Court Clerk's Office will give you the mortgage form and Promissory Note to be filled out by you or the Notary Public with the proper information for recordation. The information of the form must be typed or printed legibly. The instructions are typed on the form on the bottom of the last page. A property description must be on the mortgage form, if it is attached, the Notary must paraph if for identification with the act.

  12. After mortgage form and Promissory Note are completed the must be notarized.

  13. Bring the completed mortgage document form and Promissory Note to the District Attorney's Office* for their stamped approval for recordation. The District Attorney's Office will keep the Promissory Note. ( *619 S White Street )

  14. Return to the Amoco Bldg., 1340 Poydras Street, 5th floor, Notarial Archives Division and have the mortgage stamped with the archives number.

  15. Go back to the Mortgage Division 4th floor to record the mortgage and have the recordation information put on the bond certificate.

  16. Bring the bond certificate back to the Bond Department of the Clerk of Criminal Court's Office, at 2700 Tulane Avenue, Room 104.

  17. There is a $10 fee at the Criminal Court Clerk's Office for each bond that has to be typed, one bond for each charge on the defendant.

  18. All persons who appear on the certificate as owner must come in to the Criminal Court Clerk's Office to sign the bond and must have valid picture I.D.

  19. The defendant may post his/her own property for bond. (Federal Court Only)


  1. Copy of Property Description

    1. May be obtained from the Conveyance Division in the Amoco Building, 1340 Poydras Street, 4th floor, Hours: 8:30 am – 5:00 pm Monday – Friday.

    2. May be obtained from the Department of Property Management in City Hall, 5th Floor, Room 5W17, Hours: 2:00 pm – 4:00 pm, Monday – Friday.

  2. Assessment of Property from Assessor's Office

    1. May be obtained from the Assessor's Office, City Hall, 4th Floor, Room 4EOI, Assessor Office Hours: Monday – Friday 9:00 am – 4:00 pm.

  3. Conveyance Certificate

    1. May be obtained from the Conveyance Division, 1340 Poydras Street, Amoco Building, 4th Floor, Hours: 8:30 am – 5:00 pm, * Monday – Friday. *Both mortgage and conveyance certificates must be typed. All requests for bond certificates must be submitted to the Conveyance Division before 5:00 pm.

  4. Mortgage Certificate

    1. May be obtained from the Mortgage Division, 1340 Poydras Street, 4th Floor, Hours: 8:30 am – 5:00 pm, Monday – Friday.

  5. Notarized Executed Act of Mortgage and Promissory Note

    1. Must be executed before an Attorney or Notary Public. A fee is payable to the notary. Ask the notary or attorney what the fee is to execute the mortgage.

    2. Must be stamped approved by the District Attorney before recordation in the Mortgage Division.


  1. Documentary Transcription Tax

    1. Payable to the City of New Orleans, Department of Finance, Bureau of Treasury

    2. $325.00 within 30 days, after 30 days $800.00
